Mobile Message Service Terms and Conditions

Scope
These Mobile Messaging Service Terms and Conditions (“Terms”) govern your participation in the mobile messaging service (“Service”) operated by or on behalf of Loop BV and its US subsidiary, Loop America Inc (“Loop”, “we”, or “us”).
By providing your mobile phone number, you agree to these Terms and to receive the Service as described below.
These Terms supplement our Privacy Policy and Website Terms of Use, which also apply to your use of the Service.
Consent
By providing your mobile phone number, you consent to receive the Service, consisting of SMS/text messages from or on behalf of Loop to the number you have provided, including messages sent using automated technology. Consent is not a condition of purchase. You can withdraw consent at any time as set forth in Section 3.
Service Description
We may send two categories of messages:
Transactional messages, which may include order confirmations, shipping updates, account/servicing alerts, customer support
Promotional messages, which may include offers, product updates, contests, surveys, cart reminders, inspiration/content
Opt-out
You may opt out of the Service at any time by replying STOP to the message you received. You may continue to receive essential transactional messages (e.g., order/delivery notifications) where permitted or required to provide our services. For assistance, reply HELP or email hello@loopearplugs.com.
Charges
Loop does not charge for the Service, but message and data rates may apply from your carrier and message frequency varies. You are responsible for any such charges. Contact your carrier for details.
Eligibility
The Service is intended for individuals who can lawfully consent to mobile communications in their country. Where local law imposes a minimum age, you confirm you meet that requirement.
Data Protection
We process your personal data in relation to the Service in accordance with applicable laws, and as described in our Privacy Policy.
Limitation of Liability
The Service is supported on most mobile networks, but delivery may be delayed or unavailable depending on your carrier and location. Carriers are not liable for delayed or undelivered messages.
To the maximum extent permitted by law, we will not be liable for delays, failures or inaccuracies in message delivery or content, or for any damages arising from the Service. Your statutory consumer rights remain unaffected.
Changes to the Service and Terms
We may modify or cancel the Service or any of its features (including our phone number) without notice. To the extent permitted by applicable law, we may also modify these Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
Governing Law & Jurisdiction
Unless mandatory consumer laws of your country require otherwise, these Terms are governed by Belgian law, and disputes may be brought before the competent courts in Antwerp, Belgium.
