Loop Aurum 2024 Contest

Term & Conditions (“Rules”)

1. Organizer: The contest (the "Aurum Contest") is operated by Loop BV (“Loop”, “Us”, “Our” and “We”).

2. Rules: The following Rules apply to the Aurum Contest and are in addition to the terms and conditions contained in Our Privacy Policy and Terms of Service. Please read these Rules carefully. By participating in the Aurum Contest, You have affirmatively reviewed, accepted, and agreed to all of the Rules. The Aurum Contest is subject to all applicable federal, state and local laws and regulations.

3. Agreement to Rules: By participating, you (the “Entrant" or “You”) agree to these Rules. You represent and warrant that You meet the eligibility requirements and accept Loop’s decisions as final and binding. Any questions, comments or issues related to the Aurum Contest should be directed to Loop.

4. Entry Period: The Aurum Contest begins at on June 11th, 2024 at 12:00AM CEST and ends on July 9th, 2024 at 11:59PM CEST (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible.

5. Prize: The winner of the Aurum Contest (the "Winner") will receive a pair of limited edition 18-karat solid gold Aurum earplugs with a worth of €3,000 (the “Prize”). The Aurum collection of Loop earplugs is seen as exclusive, with only 8 pairs ever made.

6. Eligibility: The Aurum Contest is only open to those who are at least 18 years of age on the entry date and are resident of a country which Loop products are sold and shipped to. Employees, independent contractors, interns, officers, directors, and agents of Loop their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Aurum Contest. Entries must meet all Aurum Contest Rules to be eligible to win a prize. Loop reserves the right to verify the eligibility of the Entrant.

7. How to Enter: Enter the Aurum Contest by telling Loop in 25 words or less why You do/would wear Loop Earplugs at [LINK] . You must provide the information requested. Incomplete entries or those that do not adhere to the Rules may be disqualified at the sole discretion of Loop. Multiple entries or attempts to enter through multiple email addresses, identities, or devices are prohibited and may result in disqualification.

8. Score amplification: A jury of 3 people from Loop’s Customer Relations Management team (the “Jury”) will give each Entry a score based on the originality of the answer to Loop’s aforementioned question (the “Score”). You will be able to double the Score by either subscribing to the Loop newsletter or ordering any pair of Loop Earplugs with the same email address during the Entry Period, and even triple the Score if You do both.

9. Winner Selection and Notification: Winners are selected by the Jury based on correct registration, the Score, and the tiebreaker question . The Winner will be notified by e-mail on July 10th, 2024. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 5 calendar days from the time Our notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Loop shall have no liability for a Winner's failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. Any violation of these Rules by the Winner will result in the Winner's disqualification as winner, and all privileges as Winner will be immediately terminated.

10. Modification of Rules: Loop reserves the right to cancel, terminate, modify or suspend the Aurum Contest should virus, bug, non-authorised human intervention, fraud, or other cause beyond the Loop’s control corrupt or affect the administration, security, fairness, or proper conduct of the Aurum Contest. In such cases, Loop may select a winner from eligible entries received before and/or after the action taken by Loop.

11. Disqualification: Loop reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Aurum Contest or website, or violates these Rules. Loop has the right to maintain the integrity of the Aurum Contest, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Aurum Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website of Loop or undermine the legitimate operation of the Aurum Contest, may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

12. Shipment Prize: The Winner will indicate the delivery address before July 14th, 2024 05:00PM CEST. The Prize will be shipped on July 15th, 2024. Receipt of the Prize offered in the Aurum Contest by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations.

13. Limitation of Liability: By entering the Aurum Contest, You agree to release and hold harmless Loop and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Aurum Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorised human intervention in any part of the Aurum Contest; (iii) electronic or human error in the administration of the Aurum Contest or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail. Loop will not be liable for any damages or losses as a result of failure by Us to deliver the Prize as a result of any circumstances outside of Our direct and reasonable control including, but not limited to, as a result of a server failure (including but not limited to access delays or interruptions, data non-delivery or mis-delivery), any act(s) of God, war or terrorism, breaches of security or unauthorised use of personal data arising from hacking and/or failure or lack of reception of telephone or mobile telephone networks.

14. Disputes: This Aurum Contest is governed by the laws of Belgium, without respect to conflict of law doctrines. Disputes shall be resolved individually, without resort to any form of class action, and exclusively by the courts of Belgium. Participants waive the right to claim any damages beyond out-of-pocket expenses.

15. Winner Announcement: To request a copy of the winner announcement, please contact Us. Requests must be sent within two (2) weeks of the end of the Entry Period.

16. The Aurum Contest is in no way sponsored, endorsed, administered by, or associated with any social media platforms where it may be shared. You understand that You are providing your information to Loop and not to social networks.

17. By submitting Your personal details, You agree to Loop processing those details for the purpose of the Aurum Contest (including announcement of the Winner ) and in accordance with Loop’s Privacy Policy which can be viewed at https://www.loopearplugs.com/policies/privacy-policy. By entering this Aurum Contest, You will receive additional product announcements, promotions and updates regarding the products of Loop Earplugs. You can unsubscribe at any time and free of charge.

18. Loop reserves the right to alter, suspend or cancel the Aurum Contest in any jurisdiction if it is forced to do so due to illegality or invalidity of the Aurum Contest or due to binding self-regulatory rules, without any right of compensation towards the contestants.
